Terms of Service

These Terms of Service (the "Terms") govern access to the website at enclair.ai and the EnClair application (together, the "Platform"), operated by H2V SAS ("we", "our", the "Publisher"). By accessing the Platform or creating an account, you ("you", the "User") accept these Terms without reservation.

1. Definitions

In these Terms, the following words have the meanings below:

• Platform: the enclair.ai marketing site and the app.enclair.ai application.
• Service: the supply of automated audio and video summarization through AI models, accessible via the Platform.
• User: any natural person with an EnClair account.
• Account: a personal workspace authenticated by email (passwordless).
• Team: a grouping of accounts sharing the same credit pool and plan.
• Content: any audio or video file uploaded by the User, and any Summary generated from such file.
• Credits: the consumption unit of the Service, debited at each model run.
• AI Models: the third-party language models used to produce Summaries (Claude Opus 4.7, Claude Sonnet 4.6, ChatGPT 5.4, Mistral AI).
• Summary: text document produced by an AI Model from an uploaded Content.

2. Service description

EnClair is an online service that automatically summarizes audio and video content. The User uploads files, selects one or more AI Models, and receives one or more Summaries available for temporary download.

• Supported formats: MP3, MP4, M4V, WAV.
• Per-session volume: up to 5 files, 20 GB total.
• Files per session: 1 file for the Free and Starter plans, 3 files for the Pro plan, 5 files for the Enterprise plan.
• Available models: Claude Opus 4.7, Claude Sonnet 4.6, ChatGPT 5.4, Mistral AI (subject to availability), selectable individually or in parallel.
• Summary types: Classic or Scientific, short / medium / long length, optional free-text instructions.
• Activation: immediate on subscription, in less than sixty (60) seconds.
• Hosting: European Union by default (Cloudflare).

3. Account creation

Access to the service requires creating a personal account. The User agrees to provide accurate information and keep it up to date. An EnClair account belongs to a single team at a time.

Authentication is passwordless: a sign-in link is sent to the email address on file. Securing that mailbox is the User's responsibility. Any activity performed from the Account is deemed performed by its holder.

EnClair is not intended for minors under 15. Account creation by a minor under 15 requires the prior consent of their legal representative, in line with our Privacy Policy.

4. Plans, credits and billing

The service is metered by credits. Users subscribe to a plan (Free, Starter, Pro, Enterprise) that includes a monthly credit allowance. Additional credits ("top-ups") can be purchased à la carte.

5. Online cancellation

In accordance with Article L215-1-1 of the French Consumer Code, any subscription taken out online may be cancelled online, free of charge and without penalty, at any time from the team workspace:

Settings → Billing → Cancel subscription

Cancellation takes effect at the end of the current billing period. Access to the service remains active until that date.

6. Intellectual property

The Content you upload remains yours. You grant us only the license necessary to operate the Service (transcription and summarization), for the duration of processing. No Content is used to train any AI Model, whether operated by us or by a third party.

The Platform, its brand, interfaces, logos and source code are protected by copyright and trademark law. Unauthorized reproduction is prohibited.

7. AI limitations

Summaries generated by the Service are produced automatically by AI Models. The Publisher does not guarantee the absence of errors, factual accuracy, or completeness of the Summaries. The User retains full responsibility for reviewing and validating the Summaries before any use.

Summaries do not constitute professional advice (legal, medical, financial, or otherwise). Any decision made solely on the basis of a Summary is the User's responsibility.

8. Prohibited uses

The User agrees not to:

• upload content for which they do not hold the necessary rights;
• automate mass access outside of any documented API;
• attempt to bypass security controls or usage quotas;
• reuse EnClair to train a competing AI model;
• upload illegal, defamatory, or privacy-infringing content;
• share their sign-in credentials with a third party.

9. Links and third-party services

The Platform may contain links to third-party sites (notably h2v.io, the AI Model providers' pages — Anthropic, OpenAI, Mistral AI — or payment partners). The Publisher has no control over these sites and declines any responsibility for their content, privacy policies or practices.

Summary execution relies on AI Models operated by third-party providers. The associated data transfers are detailed in our Privacy Policy.

10. Availability and suspension

We make reasonable efforts to keep the Service available without guaranteeing uninterrupted operation. We may suspend access if these Terms are violated, with prior notice when possible.

11. Personal data

Personal data processing is governed by our Privacy Policy. Your audio files and summaries are kept for 24 hours, then deleted. Hosting is in Europe.

12. Limitation of liability

To the extent permitted by law, our aggregate liability for any claim arising out of the Service is limited to the amount paid for the Service in the twelve (12) months preceding the event. We are not liable for decisions made solely on the basis of AI-generated Summaries, which must always be reviewed before use.

13. Governing law, mediation and jurisdiction

These Terms are governed by French law.

Consumer mediation. In accordance with Articles L611-1 et seq. of the French Consumer Code, in the event of a dispute, a consumer Customer may refer the matter free of charge to the consumer mediator to whom the Publisher adheres: AME CONSO (Association des Médiateurs Européens), 11 place Dauphine, 75001 Paris, www.mediationconso-ame.com. Referral to the mediator is subject to a prior written approach to support@enclair.ai.

Jurisdiction. Failing an amicable resolution, any dispute relating to the interpretation or performance of these Terms is subject to the competent courts of the Versailles Court of Appeal, subject to mandatory consumer-protection provisions.

14. Changes

We may update these Terms. Active users are notified at least fifteen (15) days before substantial changes take effect. Continued use of the Platform constitutes acceptance.
